Why can the industry agreement change the answer?

French sector-level collective agreements can add or adapt rules on pay, classification, working time, leave, notice and benefits.

What is the company’s real main activity?

The applicable sector collective agreement is identified from the employer’s principal activity. The registered French business-activity classification code, called APE or NAF, is useful evidence, but it is only an indicator and does not replace the factual analysis.

A group label, the parent company’s industry or the employee’s job title may point in the wrong direction. A French entity can therefore need a different agreement from the one headquarters expects.

Probation and notice rules.
